Scope of Terms and Conditions

Article 1

  1. Accommodation agreements and related contracts entered into between the Hotel and its guests shall be governed by the provisions of these Terms and Conditions. Any matters not stipulated herein shall be subject to applicable laws and regulations, or, in the absence thereof, to generally accepted practices and customs.
  2. Notwithstanding the provisions of the preceding paragraph, if the Hotel enters into a special agreement with the guest that does not contravene applicable laws, regulations, or established customs, such special agreement shall prevail.

Application for an Accommodation Agreement

Article 2

  1. A person who intends to apply for an accommodation agreement with the Hotel shall provide the following information:
    1. Name of the guest
    2. Date of stay and estimated time of arrival
    3. Room charge (in principle, based on the Basic Accommodation Charges listed in Appendix 1)
    4. Any other information deemed necessary by the Hotel
  2. If a guest requests to extend their stay beyond the date specified in Item (2) of the preceding paragraph while already staying at the Hotel, such request shall be deemed as a new application for an accommodation agreement made at the time of the request.

Formation of Accommodation Agreement

Article 3

  1. An accommodation agreement shall be deemed concluded when the Hotel accepts the application referred to in the preceding article. However, this shall not apply if the Hotel proves that it did not accept the application.
  2. When an accommodation agreement has been concluded in accordance with the preceding provision, the guest shall pay, by the date specified by the Hotel, a deposit as determined by the Hotel, up to the amount equivalent to the basic accommodation charge for three days (or for the entire stay, if less than three days).
  3. The deposit shall first be applied toward the total accommodation charges payable by the guest. In the event that the provisions of Article 6 or Article 18 apply, the deposit shall then be applied in the order of penalty charges, followed by compensation for damages. Any remaining balance shall be refunded at the time of payment of charges as stipulated in Article 12.
  4. If the deposit referred to in Paragraph 2 is not paid by the date specified by the Hotel in accordance with said paragraph, the accommodation agreement shall become null and void. However, this shall apply only if the Hotel has informed the guest of this condition at the time the payment deadline was specified.

Special Agreement Waiving the Deposit Requirement

Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may, after the conclusion of the accommodation agreement, enter into a special agreement waiving the requirement for payment of the deposit set forth in said paragraph.
  2. If, at the time of accepting an application for an accommodation agreement, the Hotel does not request payment of the deposit specified in Paragraph 2 of the preceding article, or does not specify a payment due date for said deposit, the Hotel shall be deemed to have entered into the special agreement described in the preceding paragraph.

Request for Cooperation with Infection Prevention Measures at the Facility

Article 4-2

The Hotel may request the cooperation of persons seeking accommodation, in accordance with Article 4-2, Paragraph 1 of the Inns and Hotels Act (Act No. 138 of 1948).

Refusal to Conclude an Accommodation Agreement

Article 5

The Hotel may refuse to enter into an accommodation agreement in any of the following cases. However, this provision does not imply that the Hotel may refuse accommodation in circumstances other than those stipulated in Article 5 of the Inns and Hotels Act.

  1. When the application for accommodation is not made in accordance with these Terms and Conditions.
  2. When the hotel is fully booked and no guest rooms are available.
  3. When it is reasonably considered that the person seeking accommodation may engage in acts that violate laws or regulations, public order, or good morals in relation to their stay.
  4. When the person seeking accommodation falls under any of the following:
    1. A member of an organized crime group as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), a member or associate of such a group, or any other antisocial force.
    2. A corporation or organization controlled by an organized crime group or a member thereof.
    3. A corporation in which any of the officers is a member of an organized crime group.
  5. When the person seeking accommodation has acted in a way that causes significant disturbance to other guests.
  6. When the person seeking accommodation is recognized as a patient, etc., of a designated infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inns and Hotels Act.
  7. When the person seeking accommodation makes violent demands or requests a burden that exceeds a reasonable range (excluding requests made in accordance with Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities (Act No. 65 of 2013)).
  8. When the person seeking accommodation repeatedly makes requests as defined in Article 5-6 of the Enforcement Regulations of the Inns and Hotels Act, which place an excessive burden on the Hotel and may significantly interfere with the provision of services to other guests.
  9. When accommodation cannot be provided due to natural disasters, facility failures, or other unavoidable circumstances.
  10. When the case falls under circumstances stipulated by applicable prefectural ordinances.

Explanation of Refusal to Conclude an Accommodation Agreement

Article 5-2

A person seeking accommodation may request an explanation from the Hotel if the Hotel refuses to enter into an accommodation agreement pursuant to the preceding article.

Guest's Right to Cancel the Accommodation Agreement

Article 6

  1. The guest may cancel the accommodation agreement by notifying the Hotel.
  2. If the guest cancels all or part of the accommodation agreement for reasons attributable to the guest (excluding cases where the Hotel has designated a payment deadline for the deposit pursuant to Paragraph 2 of Article 3 and the cancellation is made prior to the payment), the Hotel shall charge a cancellation fee as specified in Appendix 2. However, if the Hotel has entered into a special agreement as referred to in Paragraph 1 of Article 4, this cancellation fee shall apply only if the Hotel has informed the guest of the obligation to pay such a fee at the time the special agreement was made.
  3. If the guest fails to arrive by 11:00 p.m. on the day of the scheduled stay without prior notice (or by the scheduled time if the estimated time of arrival has been specified in advance), the Hotel may regard the accommodation agreement as having been cancelled by the guest and may handle it accordingly.

Hotel’s Right to Cancel the Accommodation Agreement

Article 7

  1. The Hotel may cancel the accommodation agreement in any of the following cases. However, this provision does not imply that the Hotel may refuse accommodation in situations other than those stipulated in Article 5 of the Inns and Hotels Act.
    1. When it is recognized that the guest may engage in, or has engaged in, acts that violate laws or regulations, public order, or good morals in connection with the stay.
    2. When the guest falls under any of the following categories:
      1. An organized crime group, a member or associate member thereof, an affiliated organization, or any other antisocial force.
      2. A corporation or organization that is controlled by an organized crime group or its members.
      3. A corporation with an officer who is a member of an organized crime group.
    3. When the guest has caused significant disturbance to other guests through words or actions.
    4. When the guest is identified as a patient of a specified infectious disease.
    5. When the guest makes violent demands or seeks an unreasonable burden, except when requesting the removal of social barriers under Paragraph 2 of Article 7 or Paragraph 2 of Article 8 of the Act on the Elimination of Discrimination against Persons with Disabilities.
    6. When the guest repeatedly makes demands, as defined in Article 5-6 of the Enforcement Regulations of the Inns and Hotels Act, that place an excessive burden on the Hotel and are likely to significantly interfere with the provision of services to other guests.
    7. When the Hotel is unable to provide accommodation due to force majeure events such as natural disasters.
    8. When the case falls under the circumstances stipulated in Article 13 of the Saga Prefecture Ordinance on Inns and Hotels.
    9. When the guest smokes in bed, tampers with fire safety equipment, or otherwise fails to comply with prohibitions under the Hotel’s rules of use, insofar as such prohibitions are necessary for fire prevention.
  2. If the Hotel cancels the accommodation agreement pursuant to the preceding paragraph,it shall not charge the guest for any accommodation services or other charges not yet provided.

Explanation of Termination of the Accommodation Agreement

Article 7-2

If the Hotel cancels the accommodation agreement pursuant to the preceding article, the guest may request an explanation from the Hotel regarding the reason for such cancellation.

Guest Registration

Article 8

  1. On the day of check-in, guests shall register the following information at the front desk of the Hotel:
    1. Name, address, and contact information of the guest;
    2. For non-residents of Japan, nationality and passport number;
    3. Any other information deemed necessary by the Hotel.
  2. If the guest intends to pay the charges set forth in Article 12 by means other than cash, such as by credit card, the guest shall present the relevant payment method at the time of registration specified in the preceding paragraph.

Hours of Guest Room Use

Article 9

  1. The guest may use the guest room from 4:00 p.m. until 10:00 a.m. the following morning. However, in the case of consecutive stays, the guest may use the room throughout the day, except on the day of arrival and the day of departure.
  2. Notwithstanding the preceding paragraph, the Hotel may permit use of the guest roomoutside the designated hours. In such cases, an additional charge of JPY 1,000 (excluding tax) per hour will apply.

Compliance with Rules of Use

Article 10

Guests shall comply with the Hotel’s rules of use as established and posted within the Hotel premises.

Business Hours

Article 11

The business hours of the main facilities of the Hotel are as follows. For details regarding the hours of other facilities, please refer to the in-room service directory, posted notices throughout the Hotel, or the informational pamphlets provided.

  1. Front Desk Service: 7:00 a.m. – 11:00 p.m.
  2. Breakfast: 7:00 a.m. – 9:30 a.m.

Payment of Charges

Article 12

  1. The breakdown of accommodation charges payable by the guest shall be as specified in Appendix 1.
  2. Payment of the charges described in the preceding paragraph shall be made at the front desk, either in cash or by a credit card or other method accepted by the Hotel, at the time of the guest’s departure or upon request by the Hotel.
  3. Even if the guest voluntarily chooses not to stay after the Hotel has made the room available for use, the accommodation charge shall still be payable.

Liability of the Hotel

Article 13

  1. The Hotel shall compensate the guest for any damage incurred due to the performance or non-performance of the accommodation agreement or related agreements, unless such damage is not attributable to the fault of the Hotel.
  2. The Hotel maintains innkeeper’s liability insurance to cover unforeseen events such as fire.

Handling When Reserved Guest Room Cannot Be Provided

Article 14

  1. If the Hotel is unable to provide the reserved guest room, it shall, with the consent of the guest, arrange alternative accommodation at another facility under similar conditions to the extent possible.
  2. If alternative accommodation cannot be arranged as set forth in the preceding paragraph, the Hotel shall compensate the guest with an amount equivalent to a cancellation fee, which shall be applied to any damages incurred. However, if the inability to provide the room is not attributable to the fault of the Hotel, no such compensation shall be paid.

Handling of Deposited Items

Article 15

  1. As a general rule, the Hotel does not accept custody of deposited items.
  2. If any loss, damage, or destruction occurs to items, cash, or valuables brought into the Hotel by the guest due to the willful misconduct or negligence of the Hotel, the Hotel shall compensate for the damage. However, with respect to items for which the type and value were not declared in advance by the guest, the Hotel shall compensate for such damage up to a maximum of JPY 100,000, unless the Hotel is found to have committed willful misconduct or gross negligence.

Storage of Guest Luggage and Personal Belongings

Article 16

  1. If the guest's luggage arrives at the Hotel prior to the guest’s stay, the Hotel shall store it responsibly only if prior consent has been given. The luggage will be returned to the guest at the front desk upon check-in.
  2. If the guest leaves behind luggage or personal belongings after checking out, the Hotel shall, in principle, wait to be contacted by the owner and follow their instructions. If no instructions are received, valuables will be delivered to the nearest police station within seven (7) days including the date of discovery, and other items will be disposed of after one (1) month. However, perishable goods, tobacco products, magazines, items that may compromise hygiene, or items deemed to be waste (e.g., obviously broken items) may be discarded the following day, even within the storage period.
  3. The Hotel’s liability regarding the storage of guest luggage and personal belongings in the above cases shall be governed by Paragraph 1 of the preceding article in the case of Paragraph 1 above, and by Paragraph 2 of the same article in the case of Paragraph 2 above.

Liability for Parking

Article 17

When guests use the Hotel’s parking facilities, the Hotel provides only the space and does not assume responsibility for the custody or management of the vehicle, regardless of whether the vehicle keys are deposited. However, the Hotel shall be liable for compensation if damage is caused due to willful misconduct or negligence in the management of the parking facilities.

Liability of the Guest

Article 18

If the Hotel incurs damage due to the willful misconduct or negligence of the guest, the guest shall be liable to compensate the Hotel for such damage.

Notes:

  1. The percentages shown represent the cancellation fee as a proportion of the basic accommodation charge.
  2. In cases where the number of nights in the reservation is reduced, a cancellation fee equivalent to one night (the first night) will be charged regardless of the number of nights shortened.
  3. For group reservations (15 guests or more), if a partial cancellation is made, no cancellation fee will be charged for up to 10% of the number of guests scheduled to stay as of 10 days prior to the arrival date (rounded up to the nearest whole number). If the reservation was made within 10 days prior to the arrival date, the number of guests as of the date of booking will be used.
